Terms and Conditions
By making a booking, you and any others in your party are agreeing to the following terms and conditions, and confirming that you have read the FAQ section.
I / Me / My refers to Jill Pretorius, trading as Windsor Day Tours as the supplier of the tours within this website.
You / Your / Yours refers to the person making the booking and also includes the person or persons within your booking.
Party means the person or persons you have included and paid for in the booking.
An enquiry and response does not constitute a booking. I normally ‘hold’ the date for 48 hours at least, but if you have not responded after this, then the date may be given to anyone else who wishes to book.
A booking is not confirmed until you have received a booking reference from me and the deposit or full payment has been received.
The deposit is made by credit or debit card using PAYPAL. This is a secure site for you to pay and means I receive payment without seeing your card details. You may choose to pay the balance ahead of time by Paypal, or at the beginning of the tour by cash.
If you are making a booking two months or more in advance, I will accept a 25% deposit at the time of booking to hold your reservation. This deposit also covers the cost of Windsor Castle tickets and Stonehenge admission, both of which I need to pay ahead of the tour. Payment of the balance is then required (at latest) one month in advance of the date of the tour. I will send you reminders by email as the required payment date approaches. In the event that payment of the balance is not received by this date, your reservation will be automatically cancelled, and I shall be free to advertise and re-sell the date of your tour to other interested parties. I will alternatively be free to remove the date from sale, should I so choose. It may be possible to re-instate your booking with my agreement and at my sole discretion, but otherwise your deposit will be forfeit.
If you are making a booking within one month of the date of the tour, full payment is required at the time of booking.
4. Cancellations and Refunds
I am a very small business, and reliant upon filling my car. Without the following policy, a cancellation or no show means a loss of all my income for that day. The less notice I’m given, the less likely it is I can fill my seats again. Therefore I need to ‘encourage’ you, once you’ve made a booking to keep to it. If you have ANY queries about this cancellation policy, please ask me BEFORE you book, otherwise you are deemed to have agreed to it.
If you cancel the booking 4 weeks or more before the tour date, you will receive a refund of all monies paid less a £30 administration fee, and less the cost of any tickets I may already have purchased if applicable. Please note, admission tickets are non-refundable and non-transferable (as per the various organisations’ own T&Cs).
If you cancel the booking less than 4 weeks before the tour date you will receive a 50% refund of all monies paid (and less the cost of any tickets I may already have purchased, if applicable).
If you do not show up for the tour, you forfeit all monies paid. ‘No Show’ also includes you (your party) arriving at the agreed pick-up point late, after the tour has departed. So please - don’t be late. Late or cancelled plane, train, bus, or other vehicles are unfortunate, but still count as a ‘no show’..
With regards to public tours (eg the ghost tours), in the event I am able to re-sell your cancelled place(s), you will receive within 28 days of the tour date, a refund of your monies paid less the £30 administration fee.
In the unfortunate event I am ill, or through some other unforeseeable event, and unable to take the tour, I will make every effort to let you know before you leave your hotel / guest house. In the event of my illness, I will refund all your monies paid within 28 days following the tour date. If I have secured the services of another tour operator or taxi, this refund does not apply.
In the rare event I am prevented from getting to Windsor / the agreed pick up point because of snow, flooding, other inclement weather, emergency or some other 3rd party action that cannot reasonably be foreseen, you will receive a refund of all monies, less £30 administration fee, paid within 28 days following the tour date.
You agree that the amount of my total liability shall not exceed a full refund of your monies paid for the agreed booking.
Late flight or cruise arrivals: The cancellation policy will be the same as above. I will monitor flight / cruise arrivals in case of delays, and meet you at the appropriate time, but should an arrival be delayed sufficiently that a tour cannot reasonably last the full time allotted, I will endeavour to do my best to give you a shortened tour, or reschedule to another day if possible. However, no refund will be given for a shortened tour. If the plane or ship is so delayed that it is not feasible to do the tour at all, no refund will be given.
5. Responsibility / Liabilities
a) I have devised my tours in good faith that attractions and sites will be open on the day of your visit. However, it is possible that attractions, sites and other public places could be closed. You cannot make a claim for a refund or compensation in this event, as I do not have control over 3rd party actions or omissions.
b) I will act towards you with respect and courtesy. You (and your party) are asked to do the same to me and, towards other members of the tour and general public. I reserve the right to remove you or your party from the tour if your behaviour is anti-social / perceived to be, or is, threatening or aggressive or if you / your party is, or appears to be, under the influence of drugs or alcohol. I confirm that likewise I will not drink alcohol prior to, or during a tour. Smoking is not permitted in the car.
c) You shall make no legal or financial claim against me for losses and/or damages whatsoever sustained by you or your party arising directly or indirectly from any act, default or omission by you or a member of your party.
d) If you and/or a member of your party are injured or killed due to negligence on my part, as understood in English law, compensation will be awarded as entitled to receive under English law in an English Court. Any claims for compensation must be made in writing to me within 28 days following the tour.
e) I can suggest additional ‘add-ons’ to private tours, including but not limited to items such as cakes, chocolates, flowers, or gifts as well as additional activities, eg Stonehenge special access, afternoon tea, walk with llamas or birds of prey etc. I can purchase these on your behalf, but am not liable for any quality issues, misrepresentation by the supplier, cancellation or any other acts or omissions which may result in your disappointment. You are required to acquaint yourself with, and follow, any instructions which the activity organisers may impose as condition of taking part in activity. This is for your own safety and enjoyment, as well of others.
6. Claim Reward
If you tell me, on the tour, “I claim my reward”, I will give you a small token gift, in appreciation of you having read the terms and conditions. One gift per booking. Gift item may vary and is at my discretion.
7. Proper Law and Jurisdiction
This agreement shall be governed by the law of England and Wales in every particular, including formation and interpretation, and shall be deemed to have been made in England.
